That sort of misstates the test for likelihood of confusion. A consumer might, for example, believe that Apple licenses or otherwise blesses the Samsung products. That's probably good enough.

Many companies were working on them; some quicker than others. They had no need to copy from each other; there's only a few major ways to do an all-touch phone without getting weird.
That's why Jobs felt he had to show off the iPhone before the other trade shows came along, long before it was ready for sale. He did not want to be seen as second in line. (It had nothing to do with the FCC... that's a story for the naive.)

Actually, they do. They also got paid on every blank tape sold when cassettes were big. I think it is crazy for everyone to think that the music industry is greedy when it getting squeezed out of all of their revenue streams.

Ask me, phone support has been pretty lousy for years (at least since 1996 or whenever they instituted the stupid 90-day support rule that doesn't mirror the 1 year warranty.) Call up about an issue outside the 90-days and if AppleCare shoots you down (usually they will) they charge your CC. Crazy since lesser makers, HP and Dell, treat customers better. Meanwhile, you can take the same troubled machine to the Apple Store and usually the Geniuses will get your Mac fixed with little hassle.
A few years ago (I think it was the G4 Quicksilver) a phone support tech told me my (self-installed) ATA/100 hard drive wasn't working on the secondary ATA/66 hard drive bus because it was too fast! I told her that no one has made an ATA/66 hard drive for years. She told me that I shouldn't use a drive on that bus then...even those it was designed specifically for extra hard drives. 2nd Level techs wouldn't help me either. I ended up having to schlep the machine to the Apple Store where the Genius, after a few tests, confirmed I needed a new logic board.
Maybe it's just me, but phone support always wants to dismiss my issue and push me off the phone. When my MBP was whining they told me my hearing was too sensitive! Only months later did they admit a problem. Maybe THAT is why there is a growing dissatisfaction. Personally, I've loathed calling for years.

Again, Fivepoint, you forget that the President was selling the Iraq war with suspicious and weak information that the many questioned. It turns out they were right. Pre-war, the big issue was whether the war was justified based on the evidence being pushed by the President. The criticism President Bush faced thereafter had a lot to do with the fact that he lied to the American people in order to start a poorly planned war. They bungled every aspect of a war they lied to get us into. There were plenty of reasons to be critical.
Even so, in the FIRST DAYS of the war, even the lefties supported the troops and the American military, they merely questioned whether we should be going to war.
This Libya conflict is similar in that there are people on the left today questioning whether we should be "going to war" with this no-fly zone, but there are also people who support the reason behind it, but also question why we haven't gone into other countries where there are similar humanitarian issues.
Out of curiousity, what do you expect? I expect conservative congressmen and women to support a conservative president, but to think for themselves, and do what they independently think is right. I don't respect blind support like what they did under GWB. Similarly, I expect liberal congressmen and women to support a liberal president, but to also think for themselves, and do what they independently think is right. Some are speaking out, and some are not blindly supporting President Obama. Can you acknowledge that the liberals are doing a better job with consistency than the GOP? If not, how do you explain GOP opposition to the Libya action?

Well, it's certainly sweeping drama based on fiction. Like so many Oscar winners, it's also a bit of vapid fluff that people will view and quickly forget. Frankly, I didn't mean to imply any excellence other than at making completely unfounded generalizations.

Thats showing that the quad core Mac Pro is essentially the same speed as dual core Mac Pro. To translate it to normal mac scenario: If apple releases a 2.66GHz Conroe iMac/Mac/whathaveyou it will be able to crunch through FCP/Photoshop/etc faster than a Mac Pro because it can use regular DDR2 and won't suffer from horrendous memory latency.
It only shows that one company can expect to get massive complaints from its customers soon about its crappy software. An H.264 encoder can easily use two dozen cores if they are there (apart from the fact that it might be limited by the speed of the DVD drive if you encode straight from DVD); there is no reason at all why this software shouldn't be twice as fast on a Quad core and four times as fast on an eight core machine.
It only shows that one company can expect to get massive complaints from its customers soon about its crappy software. I believe that people with same-sex attractions are endangering themselves at least physically when they have sex with each other. I think they'll be a long way off getting money from every iPod sold. For a start its such an illogical thing to ask for (Did the music companies ask for money for every CD player or Tape Recorder sold? Nope), plus I suspect the main reason that Microsoft agreed to pay money in the first place is that they needed to get the music labels on board to boost the Zune Music Store, Microsoft was in the weaker position here and I believe the labels exploited that weakness.

Nice...I'm glad to have a more rare piece of hardware. I love mine and have no issues, it'll only get better over time.Reminds me of the days of the RAZR, that's what the iPhone and iPad have become.

This is a little more out there but my friend has a theory that Apple has let Kevin Smith use the new Final Cut to cut and make his new film that is coming it. The importance of this is that he feels movie making is going the way of music making these days. He believes anything under 20 million is going to be funded independently, not released via movie studios and will sell the movies directly to the theaters.
He feels only the big blockbuster movies like Transformers and stuff will be left the studios, much like many musicians are skipping the record companies and making and releasing music themselves.
Like I said, the Kevin Smith idea he had is just a theory he has, not a rumor. The Final Cut rumors are spot on and if I was a betting man I would expect to see a new version demoed next week.

The fact remains, making movies costs far far more then making music. You just can't pull $20 million out of your ass and still keep doing what you do.
